Everyday I look over countless posts on LXBN written by talented female lawyers at prominent AmLaw 200 firms. But as our guest on LXBN TV explains, the number of female lawyers in large law firms doesn’t tell the whole story, as the tally for female lawyers in leadership positions is still disparagingly low. LXBN TV: Lessons Learned from Viacom’s $1 Billion Suit Against YouTube—Baker Hostetler’s Jerry Ferguson

The Second Circuit recently reinstated Viacom’s massive suit against YouTube, a case that goes all the way back to 2007. Because the case is so old, Viacom’s copyright infringement claims really apply just to the YouTube of that time period, around 2005 and 2005, not the more mature company we see now. That said, there are many companies out there who survive on protection under the DMCA that aren’t too dissimilar to the YouTube of yesteryear. When Health & Human services goes after medical institutions for HIPAA violations, ones that comes as a result of not being careful enough with patients personal health information, they’re usually going after big-time hospitals. A recent fine levied against Phoenix Cardiac Surgery, P.C. for a HIPAA violation may be a sign that things are changing, and that they’re putting smaller practices on notice. Jared and I came into Avvocating 2012 with very high expectations for the conference. From the topics covered to the speakers who would be covering—who came from both inside and out of the legal profession—we knew the lineup would provide us with a wealth of ideas and guidance that wouldn’t only make for great content to share outside the conference, but be enjoyable to cover as well. In the end, it was even better than expected.
